Important Notice

By accessing and using VybEntry, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of VybEntry's website, mobile applications, and services (collectively, the "Platform"). VybEntry ("we," "our," or "us") provides an online ticketing and event management platform.

By creating an account, purchasing tickets, or using any part of our Platform, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations.

2. Account Registration

2.1 Eligibility: You must be at least 13 years old to create an account. Users under 18 must have parental consent.

2.2 Account Types:

  • Personal Account: For individuals attending events
  • Organization Account: For event organizers and businesses

2.3 Account Security: You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities under your account
  • Notifying us immediately of unauthorized access
  • Ensuring your account information is accurate and current

2.4 Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Platform.

3. Ticket Purchases

3.1 Purchase Process:

  • Ticket selection and checkout must be completed within 15 minutes
  • Orders are confirmed upon successful payment
  • You will receive a confirmation email with QR codes
  • Tickets are non-transferable unless specified by the organizer

3.2 Pricing:

  • All prices are listed in the currency specified (NGN, USD, etc.)
  • Prices include applicable taxes unless stated otherwise
  • Service fees and payment processing fees may apply
  • Promotional codes may have specific terms and limitations

3.3 Payment Methods: We accept credit/debit cards, bank transfers, and mobile wallets through our payment processor, Paystack. All payments are subject to verification and approval.

3.4 Failed Payments: If payment fails, your order will be cancelled. You may retry within the order expiration time (15 minutes).

4. Refunds and Cancellations

4.1 Refund Policy:

  • Refund eligibility is determined by the event organizer
  • Event cancellation by organizer: Full refund
  • Event postponement: Refund or ticket transfer at organizer's discretion
  • Customer cancellation: Subject to organizer's refund policy
  • Refunds typically processed within 5-10 business days

4.2 Non-Refundable Fees: Service fees and payment processing fees may be non-refundable, depending on the circumstances.

4.3 Refund Requests: To request a refund, go to Dashboard → Booking History → Request Refund. Include a reason for your request.

4.4 Disputes: For payment disputes, contact us at support@vybentry.com within 30 days of the transaction.

5. Event Organizer Terms

5.1 Organizer Responsibilities:

  • Provide accurate event information
  • Honor all ticket sales and admissions
  • Comply with all applicable laws and regulations
  • Maintain appropriate licenses and permits
  • Provide safe and accessible venues
  • Respond to attendee inquiries promptly

5.2 Prohibited Events: Organizers may not create events that:

  • Violate laws or regulations
  • Promote illegal activities
  • Involve hate speech, discrimination, or harassment
  • Are fraudulent or misleading
  • Infringe intellectual property rights

5.3 Platform Commission: VybEntry charges a commission of 10% on gross ticket sales, plus applicable payment processing fees (approximately 1.5% + transaction fee).

5.4 Payouts:

  • Payouts processed weekly (every Friday)
  • Minimum payout threshold: ₦5,000 or $10
  • Accurate bank account information required
  • Tax ID or business registration may be required
  • Refunds deducted from upcoming payouts

6. Marketing and Advertising Services

6.1 Campaign Creation: Organizers can create advertising campaigns on Meta (Facebook/Instagram), Snapchat, and other platforms through VybEntry.

6.2 Campaign Approval: All campaigns are subject to admin review and approval. We reserve the right to reject campaigns that violate advertising policies or community standards.

6.3 Ad Spend: You are responsible for all advertising costs. Campaign budgets are set by you and charged separately from ticket sales.

6.4 Performance: We do not guarantee specific campaign results (impressions, clicks, conversions). Performance depends on multiple factors including creative quality, targeting, and market conditions.

6.5 Third-Party Platforms: Campaigns run on third-party platforms are subject to those platforms' advertising policies and terms.

7. Intellectual Property

7.1 VybEntry Content: All content, features, and functionality on the Platform (text, graphics, logos, images, software) are owned by VybEntry and protected by copyright, trademark, and other intellectual property laws.

7.2 User Content: You retain ownership of content you upload (event descriptions, images, videos). By uploading content, you grant VybEntry a worldwide, royalty-free license to use, display, and promote your content on the Platform.

7.3 Copyright Infringement: If you believe content on VybEntry infringes your copyright, contact us at legal@vybentry.com with:

  • Description of copyrighted work
  • Location of infringing content
  • Your contact information
  • Statement of good faith belief

8. Prohibited Activities

You may not:

  • Use the Platform for illegal purposes or to violate any laws
  • Create fake accounts or provide false information
  • Engage in fraudulent ticket sales or purchases
  • Resell tickets at inflated prices (scalping) unless authorized
  • Share, copy, or distribute tickets without authorization
  • Reverse engineer, decompile, or hack the Platform
  • Use bots, scripts, or automated tools without permission
  • Spam, harass, or abuse other users
  • Upload viruses, malware, or malicious code
  • Interfere with Platform security or performance

9. Limitation of Liability

9.1 Platform Availability: We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted or error-free service. The Platform is provided "as is" without warranties of any kind.

9.2 Event Responsibility: VybEntry is a platform connecting organizers and attendees. We are not responsible for:

  • Event quality, safety, or accuracy of information
  • Organizer performance or conduct
  • Venue conditions or accessibility
  • Event cancellations or changes (except facilitating refunds)

9.3 Damages: To the fullest extent permitted by law, VybEntry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

9.4 Maximum Liability: Our total liability to you shall not exceed the amount you paid to VybEntry in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless VybEntry, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Violation of these Terms
  • Violation of any rights of another party
  • Your event content or organization

11. Dispute Resolution

11.1 Informal Resolution: Before filing a claim, contact us at legal@vybentry.com to attempt informal resolution.

11.2 Arbitration: Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court.

11.3 Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.

11.4 Governing Law: These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or platform notification. Continued use of VybEntry after changes constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.

13. Termination

13.1 By You: You may close your account at any time through account settings. Closing your account does not cancel pending orders or obligations.

13.2 By Us: We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the Platform or other users
  • Fail to pay outstanding fees

13.3 Effect of Termination: Upon termination, your right to use the Platform ceases. We may delete your account data (subject to legal retention requirements).

14. Miscellaneous

14.1 Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and VybEntry.

14.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.

14.3 Waiver: Failure to enforce any provision does not waive our right to enforce it later.

14.4 Assignment: You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor.

14.5 Force Majeure: We are not liable for delays or failures due to circumstances beyond our control (natural disasters, pandemics, wars, etc.).
